OMICS in Hot Water

HHS tells an open-access publisher to stop using the NIH, the names of its employees, and its scientific literature databases in a “misleading manner.”

WIKIMEDIA, GrindtXXOMICS Publishing Group, publisher of a suite of open-access journals, is feeling the heat from the US Department of Health and Human Services (HHS) and individuals listed as editors of some if its titles. OMICS “uses the name of the National Institutes of Health (NIH), its Institutes, PubMed Central, or the names of NIH employees in an erroneous and/or misleading manner,” according to a letter from HHS senior attorney Dean Landis to OMICSonline Managing Editor Venkatesh Yanamadala. In the letter, obtained by ScienceInsider, Landis alleges that OMICS’s website, www.omicsonline.org, has violated HHS trademarks by falsely claiming that papers published in OMICS are indexed in PubMed Central, NIH’s full text papers archive, and to PubMed, the agency’s abstracts database. In fact, those databases do not accept papers that were published in OMICS journals due to concerns raised by the National Library of Medicine, which manages the databases.

Landis also highlights an instance where an OMICS journal listed researcher Raymond Dionne as editor-in-chief and gives his affiliation as director of the NIH’s National Institute of Nursing Research (NINR). Dionne is not at NINR and was unaware that he was listed as editor of the journal, according to ScienceInsider.

In the letter, Landis demands that OMICS "cease and desist from employing [HHS's] name or the name of any of our agencies institutes or employees on your website for other than true factual statements." In response, OMICS removed a PubMed Central logo from the site and nixed a section of its FAQ that mentioned PubMed.

Dr. Gedela responded as,

In my opinion, how a single person can judge the quality of publisher like us. We are publishing around 10,000 articles per year. Indirectly Dr. Jeffrey Beall is saying all those articles are wrong. How a single person cans can judge the quality of 200 Editor-in-Chiefs and 20,000 editorial board members and 500 staff members of OMICS Group. In his opinion all of them are not following standards and he is following standards. Is he doing the good job? Will you accept? Definitely Dr. Beall is wrong.

Our legal team replied to HHS regarding the letter we got and clarified all of thier points, and initiated legal proceeding as threatened for few defamatory articles (including Dr. Beall), the
same will be resisted effectively and cornered members/organization will be held responsible for all the costs and consequences.

Along with me more than 500 OMICS Group employees are working and doing our best to make healthcare and scientific information Open Access. We have been serving the
scientific community for the last six years. This includes managing a portfolio of around 250 Open Access journals and running international scientific conferences. Last year we successively organized 75 scientific conferences without cancelling a single event, and in 2013 we will organize more than 80 conferences with the help of our 20,000-strong editorial team. In addition, we published around 500 special issues in the year 2012. The OMICS Group Facebook fans of more 50,000 indicate the representation of strong social scientific network.

Greetings from OMICS Publishing Group!

From past five years we have been submitting our articles with grants from NIH, NCI, NVI and Welcome Trust to PubMed. We have submitted around 500 articles to PubMed Central.

As per the information from our staff, we got letter from you regarding Dr. Sudhir Srivastav and Dr. Raymond affiliation with us, sorry for late reply as I am in travel.

3, 4. When I am doing my postdoc at Stanford University, I used to communicate with our editorial board with gedela@stanford.edu. I am attaching those commutations for your clarifications and to get an idea about how we started our initiative to  start open access journals. I think  during our initiation time to start journal, PubMed Central (PMC) is not there, let us  know is we have to get the approval from PMC before contacting any PI of NIH.

We also would like to state that the content in the Jeffrey Beal posting is extremely disturbing and we feel has been written without any basis and proof and with the sole purpose of defaming our client. He got legal notice from our team for this fraudulent activity.

To Jeffrey Beall, I'm very impressed with your work.  Keep those standards to a high level.  Oh, and, hey, I can lend you that BILLION  dollars there, buddy.  I have it located along with that $10,000 check, where the Sun doesn't shine, and Mr. Gedela can have it delivered into his hands at his request.
